Welcome to Startup Sweet. These Terms and Conditions (“Terms”) govern your use of our services, including website development, digital marketing, graphic design, and any related offerings provided by Startup Sweet (“we,” “our,” or “us”). By engaging with our services, you (“Client” or “you”) agree to be bound by these Terms. If you do not agree to these Terms, you may not use our services.
1. Services Startup Sweet provides website design and development, digital marketing strategies, graphic design, and related consulting services. Specific deliverables, timelines, and pricing will be outlined in a separate written proposal or agreement between Startup Sweet and the Client.
2. Client Responsibilities The Client agrees to provide accurate, complete, and timely information necessary for Startup Sweet to deliver services. The Client is responsible for securing rights, licenses, or permissions for any content (such as text, images, videos, trademarks, or logos) provided to Startup Sweet for use in a project. The Client acknowledges that delays in providing information or approvals may affect delivery timelines.
3. Intellectual Property Client Content: The Client retains ownership of all materials and content supplied to Startup Sweet. Company Work: Unless otherwise agreed in writing, Startup Sweet retains ownership of any pre-existing intellectual property, templates, or tools used in the performance of services. Final Deliverables: Upon full payment, ownership of the final deliverables (e.g., completed website, graphics, or marketing content) will transfer to the Client. Startup Sweet reserves the right to display completed work in its portfolio, marketing materials, or case studies unless the Client requests otherwise in writing.
4. Payment Terms Fees, payment schedules, and due dates will be specified in the written proposal or invoice. Payments are due as outlined in the agreement. Late payments may incur interest or service suspension. All deposits are non-refundable unless otherwise stated in writing.
5. Revisions & Approvals Startup Sweet offers a reasonable number of revisions as specified in the project proposal. Additional revisions may incur extra charges. Final approval by the Client indicates acceptance of all deliverables. After approval, any additional changes will be billed separately.
6. Third-Party Services Certain services may involve third-party platforms or providers (e.g., hosting companies, domain registrars, ad networks, or plugins). Startup Sweet is not liable for interruptions, errors, or failures caused by third-party services. The Client is responsible for reviewing and complying with the terms of any third-party services used in connection with a project.
7. Limitation of Liability Startup Sweet will perform services with reasonable care and skill but does not guarantee specific results (such as search engine rankings, website traffic, or sales outcomes). To the fullest extent permitted by law, Startup Sweet is not liable for any indirect, incidental, or consequential damages arising from the use of our services. Startup Sweet’s total liability shall not exceed the total fees paid by the Client for the specific project.
8. Confidentiality Both parties agree to maintain confidentiality regarding any proprietary or sensitive information shared during the course of a project.
9. Termination Either party may terminate a project with written notice. If terminated by the Client, the Client agrees to pay for work completed up to the termination date. Startup Sweet reserves the right to terminate services if the Client breaches these Terms or engages in unlawful, unethical, or abusive behavior.
10. Governing Law These Terms shall be governed by and construed in accordance with the laws of [Insert Jurisdiction]. Any disputes will be subject to the exclusive jurisdiction of the courts in that location.
11. Updates to Terms Startup Sweet may update these Terms from time to time. The most current version will always be posted on our Website with the “Effective Date.” Continued use of our services constitutes acceptance of the updated Terms.
